Terms of Service

Last updated 16 September 2026

You accepted these when you created your account. They are short. The part worth reading is section 3: what this service is not, and why you should check the agency's own posting before you rely on anything here.

1Who this is between

"We" is Wisconsin Builds, a business operating in the United States. "You" is the person or business using the site. If you are using it on behalf of a company, you confirm you may accept these terms for that company.

2What the service is

Wisconsin Builds compiles information about public construction bids, permits and projects in Wisconsin from records published by government agencies, and presents it in one searchable place. Where a solicitation's documents are public, we summarise what the work involves. For state highway pay items we show what comparable items have historically been awarded for.

We link to the issuing agency's own posting. We do not republish or host agencies' bid documents.

3What the service is not

It is not the official record, and it is not bidding advice. This matters more than anything else on this page, so it is stated plainly:

  • Always verify against the agency. Closing dates, addenda, quantities, specifications and eligibility come from the issuing agency. Ours is a copy, compiled automatically, and it can be wrong, incomplete or out of date. Before you rely on anything here, and especially on a bid deadline, confirm it on the agency's own posting and get on their plan holders list.
  • Coverage is incomplete, on purpose and by admission. We do not claim to carry every public bid in Wisconsin. New sources are added continually. A bid not appearing here does not mean it does not exist.
  • Historical prices are statistics, not estimates. Median and range figures describe what comparable pay items were awarded for in the past. They are not a prediction, a recommendation, or an engineer's estimate, and they take no account of your costs, schedule, site conditions or risk. Pricing your bid is your professional judgment, not ours.
  • We are not affiliated with any agency whose records appear here, and nothing on this site is endorsed by them.

4Your account

Anyone can create an account by signing in with Microsoft or Google. We never see or hold a password. Accounts are for you or your business. Do not share your access or let others use it. Tell us promptly if you think someone else has got into your account. You are responsible for what happens under it.

5What it costs

The commercial tracker is free, and we intend to keep it that way. That is the planning and permit project feed for the whole state. A free account reads a set number of projects each day, enough to follow the work in your area. The app shows today's allowance and what is left of it beside the project counter, and the count resets each day. If you need more than that, or want the data in bulk, ask us and we will arrange it directly.

Part of what keeps it free is sponsorship. A sponsor may be named on the sponsors page and may underwrite extra free projects for every reader. Sponsorship never affects which projects appear or how they are ordered, and a sponsor never receives your email address or anything else about you.

The bid board, with its bid history and intelligence features, is a future paid product. It is still in development and not open yet. Before anything you use starts costing money, we will tell you what it costs.

Anything paid is arranged directly with us, in writing. There is no checkout on this site and nothing here can charge you. Where you take a paid arrangement, its own written terms cover what it costs, how long it runs, and how either of us ends it. Those terms sit alongside these and govern where the two differ.

All of it is a work in progress: features may change, sources may be added or removed, and there is no uptime guarantee.

6Acceptable use

Use it to find and evaluate work. Do not:

The underlying public records are public. Get them from the agencies, as we do. What is ours is the work of collecting, cleaning, linking and analysing them.

7What belongs to whom

The site, its software, its design, and the compiled database, including the summaries and price analysis we generate, are ours. The underlying government records are public records and belong to nobody. Your feedback is welcome and we may act on it without obligation.

8Ending it

You can delete your account yourself, from the settings panel in the app. It cannot be undone. You can also email us and we will do it for you. The Privacy Policy says what is removed and what stays.

Ending a paid arrangement is a separate thing, and it is not done from the app. Tell us, and we will end it on the terms of that arrangement. Closing your account does not by itself cancel something you are paying for, and cancelling does not delete your account.

We may suspend or close an account that breaches these terms, and we may discontinue the service, with reasonable notice where we can give it.

9No warranty

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including any warranty of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, timely, or error-free.

10Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business, missed bid opportunities, or bids priced in reliance on information found here. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11Governing law

These terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Wisconsin, and both of us consent to that.

12Changes

We may update these terms. If a change is material we will update the date above and let account holders know. Continuing to use the service after a change means accepting it.

13Records are linked automatically

We gather records from many agencies and link them into projects by software. Across thousands of projects some of those links will be wrong: two filings joined that belong to different buildings, or one building shown twice. Check any project against the filings listed on it, and against the agency's own record, before you rely on it.

14Links and agency sites

We link to agency pages and other sites we do not run. We do not control them and are not responsible for what they contain or do. Their terms, not ours, govern your use of them.

15Your responsibility to us

If you use the service in a way these terms do not allow, or break the law with it, and someone brings a claim against us because of that, you will cover our reasonable costs, including legal fees.

16Time limit on claims

Any claim about the service must be brought within one year of when it arose. After that it is barred, unless the law says otherwise.

17If part of this does not hold

If any part of these terms is unenforceable, the rest stays in force. These terms, with the Privacy Policy, are the whole agreement between us about the service. You may not transfer your rights under them; we may transfer ours if the business is sold, and we will tell account holders.

18What survives

Sections 6, 7, 9, 10, 13, 15, 16 and 17 continue to apply after your account ends.

19Things outside our control

We are not liable for failures or delays caused by events we do not control, including agency outages, network or hosting failures, and acts of government.
